dc.description.abstract | Copyright law bestows creators with exclusive rights over their unique creations, newlineguaranteeing privileges for replication and distribution. Nevertheless, these rights are not newlineunrestricted and are counterbalanced with restrictions and exemptions to uphold public newlineinterests, social welfare and to fulfil access requirements. In Copyright law one important newlineaspect is the doctrine of fair use (as commonly known in the United States)/ fair dealing (as newlinecommonly known in the United Kingdom and other Commonwealth countries). These newlineprovisions allow for the restricted use of copyrighted material by the content users without newlineobtaining permission, specifically for purposes such as research, private studies, criticism, newlineeducation, and so on. Like fair use , compulsory and statutory licences are essential in allowing newlinethe dissemination, distribution and use of copyrighted works under certain specific newlinecircumstances, such as payment of licence fees/ royalties. These licences are particularly newlinesignificant in the fields of broadcasting and music. In addition, libraries and archives have newlineexemptions specifically for the purpose of preserving and conducting research, whereas newlineeducational institutions enjoy exemptionsspecifically for the purpose of teaching. Additionally, newlinethere are mechanisms in place to ensure that those with impairments have access to works in newlineforms such as Braille. Crucially, works that are in the public domain are exempt from copyright newlinelimitations and can be utilised without any restrictions. The first sale doctrine grants the right newlineto resell physical copies without requiring additional permission. Certain countries newlineacknowledge exceptions for transitory technological process copies, such as caching. The newlinelimitations and exceptions differ among different legal regimes, since they aim to strike a newlinebalance between the rights of artists and the public interest... newline | |
