Abstract: The right to speedy justice is an indispensable right embodied in the body and spirit of criminal jurisprudence. Right to speedy justice is a constitutional right in USA whereas the Supreme Court of India has declared right to speedy justice a fundamental right under Article 21 of the Constitution of India. But the implementation of right to speedy justice is still a big challenge before the machinery for administration of justice in India. This research analyses the various aspects of the malady of delayed justice with special reference to criminal justice system of India and USA as well as suggest the measures for eradicating the issues of delays effectively, efficiently and with a limited period frame work. newline
