Abstract: Homosexuality is admittedly not a disease or mental illness which needs to be treated medically, or which can be, ever be cured or altered , it is just divergent expression of persons sexuality. Even then the ground reality is that sexual minorities in India are largely stigmatized and disempowered socially, culturally, politically, legally and economically. Dilution of ironic archaic Section 377 IPC by the Supreme Court Constitutional Bench in the lawsuit of Navtej Singh Johar and Ors. v. Union of India thr. Secretary Ministry of Law and Justice by declaring that Section 377 is unconstitutional in so far it convicts private consensual sexual act between same-sex adults. Likewise,various court judgments in recent years have laid the groundwork for better protections from exploitation and discrimination based on sexual orientation and gender identity, and the Indian government s stance on LGBT rights has evolved considerably. But much more is needed to protect individual on the basis of sexual and gender identity in India. newline
