Abstract

The present research study has been modulated by making a general study on the research problem, Examining the Applicability of the Concept Creamy Layer in Reservations to SC and ST . The researcher has made an intensive study on the research problem and tried to establish the synergy between the Concept of Creamy Layer and Reservations to Scheduled Castes and Scheduled Tribes. The socially and economically better placed among the beneficiaries to reservation are known as the creamy layer. Reservations are supposed to uplift the historically oppressed so as to enable them to compete with the more advanced sections of society. But as the benefits are grabbed by the tiny elite i.e., the creamy layer, the weakest of the weaker sections of the society are left without any access to welfare. newlineA provision of law should be dynamic serving the changing needs of the society. Accordingly, it is expected that certain sections of Scheduled Castes and Scheduled Tribes to have become socially and economically advanced. Therefore, it becomes important to review the methods for the determination of the real beneficiaries of reservation policy and to ensure that the criterion for the identification of subclasses within SC and ST category are relevant as per present scenario. newlineThe thesis makes an attempt to answer some important research questions relevant for the research problem like, Whether Scheduled Castes and Scheduled Tribes form a class or list of castes ; Whether the group Scheduled Castes and Scheduled Tribes constitute a homogeneous or heterogeneous class; What is the basis of subclassification of Scheduled Castes and Scheduled Tribes; Whether the concept of creamy layer be applied to Scheduled Castes and Scheduled Tribes; What are the Relevant parameters for intelligible differentia for the creation of the creamy layer among Scheduled Castes and Scheduled Tribes newlineThe thesis will try to identify and address the unresolved areas in the reservation policy especially the application of the concept of creamy layer
