Abstract: The violence against women highlights the naked feudal mentality of the Indian society. The violence against women is also referred as gender based violence in Indian society. It is very unfortunate that the nature of the sexual and gender based violence are the violent and illegal acts committed under the influence of patriarchy, primarily or exclusively against the women or girls. These violence are exclusively known as a form of hate violence which has been committed against women or girls. newlineThis thesis along with the doctrinal study mainly rest and best upon the socio legal study. A great emphasis was laid down on empirical study. Women are victim of violence since long time. To tackle the violence against the women we look towards Criminal Justice System of the state as a means to provide solution. To combat the violence against the women the Governments of India and various state governments have launched many schemes. newline This study includes critical evaluation of the provisions relating to constitution of India and other legislative enactments and to trace their suitability and applicability to combat the violence against the women. Some pages of this thesis is also devoted to reason cause objective purpose origin of the legal safeguards against the violence of the women. The supporting and opposing to existing legal safeguards is also the subject matter of research. With the help of the decision relating to violence against the women the judicial response is also subject matter of our study and to find out how and in what way judiciary acted and reacted to the problem of violence against the women. In a great detail the thesis will cover the socio legal challenges of violence against the women in India with the help of on the spot study consisting of questionnaire methodology, meeting method, individual interview and visit to the place of occurrence and having a meeting with some persons having specialized knowledge regarding women s rights as well as the victim of the violence.
