Abstract: | In common parlance, independence means not depending on authority or newlinecontrol; not depending on another thing for validity or on another person for one s newlineopinion or livelihood and unwilling to be under obligations to others.quot Independence of newlinejudiciary would certainly mean freedom of the institution from others. However, when newlinethe term independence qualifies judiciary , it commands a wider connotation. It is newlinewide enough to include independence not only from an outside authority but also from newlineitself. In other words, the expression independence of the judiciary encompasses newlinefreedom not only from its sister authorities like legislature and executive but also from newlinethe judicial hierarchy. Independence of Judiciary is a sine qua non of vibrant democratic newlinesystem. Only an impartial and independent Judiciary can stand as a bulwark for the newlineprotection of the rights of the individual and mete out even handed justice without fear newlineand favour.1 Since the Judiciary is the guardian of the Constitution so any action of newlinelegislature and executive which is not in consonance of the provisions of the newlineconstitution may be declared as null and void.
