Abstract: | When gender discomfort occurs in a person and he/she tries to find comfortable newlinein the other gender and these people are known as transgender. The society sees them as newlinea third gender. It is the nature of the society that they accepts only what is known to newlinethem and same is in the case of humans also, here they accept only the male and female newlineversion and the third version or the transgender persons are always seen as something newlinedifferent. Right to equality is one of the most important and prominent fundamental right newlineprovided by Indian Constitution to its citizen. When we analyze whether this right to newlineequality is enjoyed by the transgender community, majority of the answer will be No as newlinethey had to face / are facing various kind of discrimination from several walks of life newlineonly because they belong to the transgender community. In India during the ancient times transgender persons are given prominent place in the Kings palace. Transgender persons are known by several names in different parts of India. Some of the common names Hijara, Hijadas, Kothis, Devadasi, Aravani, Jagappa. Hijaras have a well-recognized history right from the time of KamaSutra. Hijara is an Indian or Hindustani word which was traditionally translated to English as Hermaphrodite where the main focus is in the irregularity of the male genitalia. newlineThe fight for the official recognition of these groups as transgender persons or newline third genders began in the late 20th century and in 2014 Indian Government officially newlinerecognized Hijaras, transgender people and intersex people as third gender in law. But as per the new order from Kerala Social Justice Board, Government of Kerala in 2019, newlineregarding Transgender Terminology in Official documents the term Third Gender newlineshould not be used in any official documents and instead the term Transgender can be used to address them. Order Gender-based victimization, discrimination, bullying, newlineviolence, being rejected by the family, friends, and community; harassment by intimate newlinepartner, family members, police.. |
