FDI laws in India and foreign investment protection

Abstract

As the importance of foreign direct investment (here-in-after FDI) to the global newlineeconomy increases, there is a growing need for stable and well-tailored FDI newlineregulatory framework that will not only promote but also protect investment. This newlineintroductory chapter attempts to give a preliminary backdrop of the actual focal newlinepoint of the research by introducing the target area and the broad spectrum of FDI newlineregulatory power in India. The FDI regulatory framework consisted of RBI, DIPP newlineand FIPB, when back in 2015, this research started. The legitimacy of the FIPB newlinewas one of the fundamental contentions of the research in the beginning. The newlinereason being, FIPB s objective though was of promoting FDI but it remained newlinemerely an approving agency since the inception. And there were many instances of newlineoverlapping of power, but in 2017 the finance minister during his budget speech, newlineannounced the phasing off of the FIPB and the Cabinet ultimately phased it off, newlineclaiming that the FIPB has reached a saturation. newline
