Protection Of Traditional Knowledge Under The Intellectual Property Rights Regime With Special Reference To India An Analytical Study

Abstract

The study found that the apparent non-systematic manner of creation of traditional knowledge does not diminish its cultural value, or its value from the point of view of technical benefit. Traditional knowledge is usually connected with newlinebiological resources and is always an intangible element of such biological resource. newlineTraditional knowledge has the potential of being decoded into commercial benefits by newlineproviding leads/clues for growth of useful practices and processes for mankind newlinebenefits. The treasured leads/clues provided by traditional knowledge save time, newlinemoney and venture of contemporary biotech and other industries into any research newlineand product growth. Logically, thus, a part of such benefits should be provided to the newlinevi newlineoriginators and/or traditional knowledge holders. Few nations have explicit law newlineshielding such type of knowledge while few other nations feel their current IPR newlinemanagement defend such knowledge. A local rule must be established for the newlinetraditional knowledge protection associated to biodiversity which comprises newlineagriculture, medicinal, ecological linked knowledge; and for the defense of other newlinetraditional knowledge connecting to folklore.
