dc.description.abstract | quotThe prime objective of every construction project authority is the completion of a project that meets the objectives of time, cost and quality. However, the construction process is often fought with disputes over the interpretation of construction documents, existing conditions, the legitimacy of variations, timely payments, etc. The emerging Alternative Dispute Resolution (ADR) methods which are non-litigation alternative offer opportunities for effectively resolving disputes in the construction industry. Depending on the nature of the relationship between the parties involved in the disputes and the circumstances under which the dispute is evolved, different methods of dispute resolution mechanism may be preferable. This research reviews alternative dispute resolution methods in construction industry with an assessment of the Indian situation. It provides insights into decision making on appropriateness of dispute resolution method that suit their needs. newline newline newlineThe Construction industry in India and Gujarat has prime importance for Indian economy and is the second largest industry, next to agriculture. Currently, infrastructure development of construction projects, more particularly Irrigation project, occupies a key position with 53% budget allocation ( table 1.1), which may increased up to 85% due to litigation and liabilities. In any construction project contract time and cost overruns is common, which gives rise to claims leading to disputes. These disputes if not handled properly tend to consume time and money of all parties to the contract. To resolve the dispute in optimum time, it is essential to understand the root cause of disputes as early as possible. Hence there is a need of analyzing the disputes scientifically. The present study reveals from the study of arbitration process and awards that the causes for delay claims can be grouped in domains and the probable decisions to the disputes can be traced through the probing questions considered by decision makers.
