dc.description.abstractThe performance and viability of Banks and Financial Institutions mainly depends on the optimum utilization of their resources especially financial resources. For this credit management becomes more vital to achieve the said concerned as in emerging economies like India. The magnitude of advance made by formal commercial institutions and their recovery mechanisms are important for the proper functioning of Banks and Financial Institutions in that country. In India after Liberalization, Privatization and Globalization the formal financial system has been spreading its wings and soared to almost all strata of the society but simultaneously recovery of the credit made by banks has continuously been a central issue rather problem. Therefore, SARFAESI Act, 2002 was enacted and implemented to resolve the issue of NPA. The research study has tried to find that the Act has really empowered the Banks and Financial Institutions to deal with newlinecases of NPA particularly for legal compliance and procedure, or not. Further, the study has explored the impact of SARFAESI Act, 2002 on Banks and Financial Institutions as well as identified the challenges in the implementation and suggested the legal measures for making the said Act more effective for NPA management.
