Evolving international humanitarian legal regime for sustainable use of outer space and its application to India

Abstract

This research is basically Lex-Cosmic-Enviro-Humano (LCEH) study focusing on maximum exploitation, with minimum damage for a Conflict Free Outer Space Exploration (CFOSE). Commercialization of outer space activities needs a shift to sustainable development and this research is an effort to understand the rapport amongst law, science and environment with respect to space activities, as the concept of common heritage of mankind is getting diluted and commercialization of space is gaining momentum. Researcher has analysed certain principles applicable to international space law, international law, international environmental law and human rights including humanitarian laws. Also done comparative analysis of national space laws and specific analysis of Indian space activities. Researcher aimed to bring international legal framework with respect to the exploitation and exploration of outer space by nations and private entities, and for this proposed through this research: International Code of Conduct for Humanitarian and Sustainable Use of Outer Space (ICHSOS) and Establishment of International Tribunal for Outer Space Activities (ITOSA), to deal with outer space activities in a better way. newline
