Center staging international human rights humanitarian and environmental concerns in the natural disaster management legal regime an evaluative study

Abstract

It is unfortunate that despite technological advances and changes in the approach of disaster management, natural disasters are on the rise worldwide with India among the top three most-affected countries. This thesis views such a failure on the part of the state to protect its people from disasters as a human rights issue. Hence, it calls for the promotion and protection of minimum core of the socio-economic rights of the disaster victims, which is further deeply rooted in the right to a safe environment. It deals with the international and national law, responses of the judicial and administrative authorities; to evaluate the adequacy of such protection. In the process, it has also analyzed the legal framework in the US and its response towards the victims for consideration as a referral point. Finally, the thesis attempts in building a rights-based jurisprudence for the disaster victims and provide valuable inputs in developing a legal framework ensuring better disaster governance. newline
