Competition Issues In Energy Sector In India A Critical Legal Study

Abstract

As we know that competition is important to increase the efficiency of infrastructure sector and it also improves the quality of service as well. Various reform has been done in this regard which started a shifted from a predominantly government-owned system to offering increased level playing field for both public and private sector. But still issues related to competition in energy sector still confront India as a result it decreases the efficiency and consequently India is facing the deficiency in power sector. The existing legislation has been drafted with the aim to energy access to the entire population however it could not produce the desired result and in India, there is a huge gap between demand-supply which raises serious concerns in relation to energy security, thus it affects overall economic growth. This thesis discuss the present status of energy sector subsector namely coal, oil, electricity, renewable energy etc. It examines the existing legislative, regulatory and institutional framework and lacunas existing therein and relevance of doctrine of essential facility. Further it discuss the competitive issues involved in energy sector and how the concession contract can improve the efficiency in electricity,oil and gas sector and it also discusses the position in different countries. At last it deals with conclusion and suggestion.
