Inter Country Adoption A Comparative Study in International Perspective with specific reference to United States of America United Kingdom and India

Abstract

Adoption is regarded as the most perfect means to restore a child who is deprived of his natural parents or whose parents are in heaven. Inter- country adoption or international adoption means an adoption of a Child of one country by the parents of another country, it is also termed as cross border adoption. The present research work has been taken up with the objective to analysis the inter-country adoption process and compare the different provisions of inter country adoption with specific reference to USA, UK and India. An effort was also made to analysis the different problems related with inter-country adoption, and the magnificent role played by judiciary and suggest the solution to the different problems of inter country adoption and propose a model act to solve the present problem suggest further research for development/amendment. For achieving the objective, extensive literature survey was carried out citing various case and literature including the Hague Convention on Inter Country Adoption, 1993, and guidelines of CARA. The researcher has undertaken both doctrinal and non-doctrinal form of research. An appropriate hypothesis was developed and tested using statistical techniques. Based on study the researcher has suggested a model law which is the most imperative outcome of the thesis. However, this model law will resolve the problems/issues related with inter country adoptions which are comprehensively research work and also expected to act as a panacea for all issues. newline
